Tampa Negligent Security Lawyers
Every day there are people injured in the Tampa Bay area as result of poor
security. When you travel to a place of business such as a restaurant,
hotel, mall, parking garage or apartment complex, you have an expectation
that you will be safe wherever you travel. If you are assaulted while
in a public place, you may be able to make a recovery against the owner,
operator or lessee of the business where the attack took place. In order
to make such a recovery, you must prove that the owner of a business knew
of prior security problems, but took no steps to fix the problem.
This is done by proving prior similar attacks took place on the premises,
what security measures were in place during those prior attacks and what
security is in place now. We look at whether the attack was preventable
through security measures such as security guards, lighting or surveillance
cameras. If we can show that the use of such measures might have prevented
the attack, you may be able to recover damages for negligent security.
Owners not only must provide you a safe business place, they have a duty
to insure their employees will do you no harm. Each business has a duty
to screen its employees to insure they do not have criminal or violent
backgrounds which could put patrons at risk. Background checks can be
conducted at little cost, to help insure employees do not rob or assault
persons who come on premises do business.
Although some attacks may never be preventable, a significant number of
attacks are preventable if the owner takes steps to protect its patrons.
The owner must be on notice however, of a need for such security. It is
only common sense that certain locations like ATM machines and bars might
require increased security because the opportunity to commit a crime is
much higher at these locations. But the duty to put those measures in
place is not universal. Negligence is determined on a case by case basis,
so an investigation into the past history of the business is a critical
piece of the claim.
If you have been the victim of a violent crime, contact us for a consultation.
